While we say goodbye Adv. Bishwa Ranjan Paramguru


With a heavy heart we express our deepest condolence on death of Adv. Bishwa Ranjan Paramguru. Adv. Paramguru, a young outstanding amongst lawyers marshaled brilliantly in National Green Tribunal (NGT) representing Ramesh Gauns in litigation challenging grant of Environmental Clearance by MOEF&CC to Vedanta Limited Mines at Bicholim Mineral Block I.


Adv. Paramguru died in road "accident" in Bhubaneshwar, Odisha on 10 September 2025. Details surrounding his death are yet to be ascertain.


Adv. Paramguru braved formidable obstacles to get the case admitted to NGT Pune. He followed very high ethical standards are refused to be lured by opposition luring financial offers.


I was amongst those fortunate to have shared time with him in Goa as well as Odisha. His jovial humble nature was rather unusual for the brilliance that he carried over his shoulders. His expressed fears about snakes and the way he expressed them while tracking Goa's mining belt ofter pushed people around us into jiffy. 


I often joked about his surname that he is supreme teacher - Paramguru. And he would reply "No sir, I got that surname from my parents, nothing more." After his death I realised that he so neatly bluffed me!


While he was amongst us he set us into high level of comfort and joy, news of his death came as rude shock unleashing sorrowful tears from deepest core of my being. 


I share no competent words to describe Adv. Paramguru's contribution to defending Goa's ecology from mining corporate aggression. Few in this world are enigmas and Adv. Paramguru is amongst them.


We have no words to console his school going daughter, young wife, his brother and all those share close affinity and friendship with him over thus loss. May they find courage to move on in life. For those of us who shared close moments in struggle his life remains an experience so deeply inspiring: a boy born with no silver spoon in his mouth could attain position of strength and influence, defending those on margins, upholding Justice in courtrooms, showing that human can remain unflinching, uncompromising in the face of adversaries as mammoth and as dangerous as mining industry. 


While we say good bye my friend we leave a taste of what he stood to defend about Goa, it's people, life and economy and ecology:

Goa CM pitches to mid-night mining transportation?

Reports in Marathi daily on 12 December 2024 about Goa CM intervention in support of Vedanta operated Bicholim Mineral Block - I is truly bizzare.


CM after the failed talks with Pilgao farmers on December 08, 2024 came up with an idea beyond rule books of the mining trade : mining transportation on public roads during day time as well as at night.


In this context certain things must be noted:


1. Terms of Reference for Bicholim Mineral Block I discourages mining ore transportation by road.


2. Vedanta Limited went ahead declared that it will use 900 meters of public road to reach at Sarmanas Jetty.


3. Environmental Clerance granted in January 2024 accepted Vedanta's request for the use of 900 meters of Public Road.


4. Mineral Transportation needs to be during day during time spans with breaks specified in Environmental Clearance ending at 6.30 pm.


5. Never in history of Goa Mineral transportation was officially sanctioned at night. Even the Mineral loot of 35,000 crore rupees was carried on during day time trips. 


6. Goa CM has recommended ore transportation during mid-night on portion of public road connecting Bicholim town to Sarmanas Jetty from 11.30 pm to 5.00 am. 


7. Logic for this recommendation is based on CM's assessment that only 5 houses are in the risk of sleep disturbance at night. Therefore it is alright if their sleep is disrupted at night for five families disrupted daily night sleep is no disturbance at all! Wiered logic indeed. It fit into CM's logic because his sleep will not be disrupted. He cares a damn for other people's sleep. From CM's decision it's clear that he is not going to reside in any of the five houses where sleep will be chronically disrupted due to mining loot at day and night. 


7. This recommendation on night mining transportation at day time and night time is in violation of Environmental Clerance condition that requires mining trucks to halt operations by 6.30 pm.


8. The decisions of CM Sawant to push for night transportation places him in the category of violators of Environmental laws of India and liable to be prosecuted for ecological crimes along with the officials of Vedanta Limited.

High Alert! Oncoming Police repression on People of Bicholim Taluka over mining

Today 10 December 2024 observed as International Human Rights Day. There is however very disturbing piece of information that has come in today; Goa's Sawant Government is all set to unleash police terror to resume iron transportation to benefit London based Vedanta corporate currently in the middle of plunder of Goa's minerals in Bicholim Taluka.


Corporate hasn't been able to carry its plunderous trade over Goa's iron ore due to iron willed determination of Pilgao villagers who raised red flag over ore transportation from their paddy fields and blocked road for past 25 days.


Few days ago Pilgao farmers were called for discussion to resolve this issue at Sankhelim Ravindra Bhavan. Over there Chief Minister Sawant threatened the farmers of arrests in case they continue to resist mining transportation from their paddy fields in Pilgao. Farmers wanted all the mining silt dumped in their paddy fields by mining companies at Pilgao to be cleared out so that cultivation of paddy etc can resume and food security restored. However Chief Minister Sawant was at his arrogant best and declared that he will get police to act repressive against agitating farmers.


According to the sources police repression on people of Pilgao is likely to resume from 11 December 2024. 


Bharat Mukti Morcha therefore calls upon everyone concern to be on high alert and monitor situation unfolding in Pilgao, and be prepared to respond in emergency of lathi charge and other repressive measures.


Terms of Reference of EIA clearly directs project proponent against the use of Public road for the transportation of Iron ore. Vedanta sleathly was allowed to breach this clause in January 2024 Environmental clearance and use of 900 meters of Public road was allowed. Now Vedanta Limited is pouncing on stretch of 2.5 kms of Public road connecting Bicholim town to Sarmanas Jetty. This is unacceptable. Risks multiplies for all the commuters on public road.


This situation is clearly violation of Environmental Clearance (EC) for Bicholim Mineral Block I, and if MOEF & CC fails to cancel this EC then it be held responsible for unleasing law and order situation in Goa.


It is normal to question: was this is the reason why India annexed Goa through conquest armed with Soviet Veto in 1961?

Press note on Vedanta Bicholim mine

Appeal No. 30 of 2024 has been filed against Vedanta Ltd Challenging Environmental Clearance to Bicholim Mines, Goa

These are the following grounds

Mining Lease wrt Survey No. 25 canot be enforceable. As Survey No. 25 is Lamgao Lake, a wet land. This can not be used as a settling pond. Mining in water body is strictly prohibited.(Rejoinder Para-6)

Vedanta suppressed its previous illegal mining in its present Bicholim Mining Lease Area. In response to the Para 4 ‘Miscellaneous’ 4.6 of the TOR, state of Goa gave in its clarificatory Letter gave false information regarding illegal mining. 

Lamgao Lake is completely destroyed due to illegal mining by PP. No action Plan in EIA to protect the Lake.


Vedanta Ltd was selected as the preferred bidder in the said auction for Block I Bicholim mineral block and accordingly LOI was issued to Vedanta Ltd. As per the MoEF&CC EAC minutes of meeting, in case of LOI grant it is classified as green field and hence in the EIA it has been mentioned as green field. There is no hiding of facts as alleged by the speaker/ goa foundation, as the earlier pits can be seen in the surface plan which is provided as plate no 5 of EIA. (1313)

Pilgaon villagers checkmates mining loot of Goa


Villagers of Pilgaon, Bicholim stopped Vendanta limited mining trucks from plying on public road last night. They are permitted ore transportation upto 6.00 pm but last night it went past 7.30 pm. Backed by local Panchayat people came on road and blocked mining trucks from operating on Public Roads. It is very important steps by Pilgaon people to confront corporate loot of Goa.

Iron ore transportation is being carried on from Vedanta Mines at Bicholim Mineral Block I causing Public Health hazards. Following spillage of ore on public road movement of vehicles and pedestrians has turned increasing risky.

Ecological sacrifice for mining: case of Cudnem Mineral Block VII in Goa

Its unbelievable that Goa Government as created mining lease Cudnem block VII with 5.3612 ha of forest land within. These are the times of acute ecological crisis and such disgust to note that Goa's forest is on the way go for Vedanta, British mining company.


Cudnem mineral block consisting of 75.30 ha of land is going for Public Hearing today 18 October 2024 at 10.00 am at Ravindra Bhavan, Sanquelim for both mining of the ore as well as beneficiation plant which is essential environmentally dirty bussiness of washing of the iron ore extracted from an open cast mining pit.

Mining lease covers Sattari-Bicholim border villages of Honda, Sonshi and Cudnem and have already experienced mining tragedy for several decades.

EIA and EMP reports put out in Public domain by GSPCB itself has observations that are damaging. The entire location of the proposed mining activities are in ecologically highly sensitive area and it have several watery features.

Para 3.3 outlines how many rivers, nallas, dams, lakes etc flow from distance close to the mining lease:

"Water Bodies   (Note: There are other several Water Bodies within 10 kms buffer area)  Harvalem water fall 1.65 km, Cudnem River 0.23 km, Mandovi River 3.88 km, Valvanti River 3.95 km, Anjuem Dam 9.72 km, Bicholim River 9.30 km, Mhadai River 7.32 km, Seasonal Nalla Near Khodginum Village 1.70 km, Seasonal Nalla within the Mineral Block, Within the Mineral Block Area PP Shall maintain 50 m buffer Dhakul, Lake 3.95 km, Taleshwar Lake 3.90 km Crocodile Lake 4.71 km, Mandodari Lake 5.76 km,  Batwadi lake 6.87 km, Ajobachi talee Lake 7.84 km, Banana Water fall Zarme 8.00 km, Cumbarjua Canal 8.08 km, Aerekere Lake 9.08 km, Advoi Nalla 8.00 km, Ragada River 9.6 km."

Wetlands too are listed:

"Navelim (Not Notified) 1.90 Betal Temple Lake (Draft notified) 8.86 km, Kolamwada Lake (Draft Notified) 5.50 km, Vijayadurga Lake (Notified) 7.91 km, Banastari 9.49 km."

Impact on ground water is noted at para 4.7.2:

"The mining operations shall intersect the ground water table as the deepest mine workings in the mining plan period is -10.5 mts. Therefore, it requires major pumping  operations."

EIA report is categorical about Impact on wetlands at para 4.8.5:

"There are few wet lands present within the study area of 10 kms radius. The nearest wetlands to the mineral block area are Navelim (IBA) : 1.90 kms, Betal Temple Lake (Draft notified) -8.86 Km Kolamwada Lake (Draft Notified )  -5.50 km Vijayadurga Lake (Notified) -7.91 Km, Banastari -9.49 Km

Major impacts of mining on wetlands are anticipated:

"Destruction of wetland habitat:

Mining can indirectly damage the Habitat & environment.
 Water pollution: Mining can pollute surface and groundwater with chemicals like heavy metals i.e., Iron, Manganese, and toxic metals.
 Degradation of growth conditions: Mining can degrade the conditions for growing wood, land vegetation, and water flora and fauna.
 Bird’s migration: Mining can cause wild species to migrate and reduce their numbers.
 Aquatic Life : Mining can also effect the aquatic life
 Reduction of wild-growing plants: Mining can reduce the number of wild-growing plants.
 Water pollution

Impact on population in buffer zone (Page 133) covered under para 4.9.1 as under:

Majorly water pollution will be the suspended matter which flow from the mine during rainy season into the nearby nallahs. There is one Seasonal nalla within Mineral Block
1. Cudnem river – 0.23 km
2. Harvalem Water falls – 1.65 km.

Major Health Impact due to dust on Habitation warned:

Respiratory diseases due to dust Skin diseases due to pollution/ dust etc.

4.9.5 Impact on cropping patterns (Page 135) is familiar admittance:

The mining activities may impact agriculture due to air pollution, flowing of silt in agricultural land.

Para 6.3.5.1 notes about ground water levels:

"Water levels in wells at varying distances all around the project area shall be monitored every month." This is major blow from Vedanta Limited will come onto ground water of the locality. It's huge price to pay and must never be allowed.

Para 6.4 of EMP has brief note about Reporting Schedule:

"The environmental monitoring report will be sent to Goa State Pollution Control Board on a monthly basis and MoEF&CC & CPCB on a six-monthly basis. Copies of the reports will be maintained at the Mine and will be made available to the concerned inspecting authorities like Indian Bureau of Mines (IBM), GSPCB, MOEF &CC etc." It's clear that Public will have no access to the monitored reports while Impact will have to be faced by public.

Table 3.19 has a column titled Pre-mining use and area of land use of the mining lease of the total 75.30 ha. It has detail break up data of land use. Of this three items are significant:
1. Degraded by Pits & Excavation 19.757 ha
2. Degraded by Dumps and Material Standing 14.5936 ha
3. Covered under mine infrastructure 1.9582 ha

Together the above three items totals 36.12 ha which is more than 50% of mining lease minus 5.3612 ha of land under forest. So even though there is claim of pre-mining use the land is already used for mining.

Para 2.6.4 of EIA details out sourcing of daily requirements of 95 KLD for mining purpose. Daily 10 KLD will be sourced from buffer villages wells. Closest 5 kms radius buffer zone village list given as under:

1. Poriem
2. Podocem
3. Arvelem
4. Virdi
5. Sanquelim
6. Amona
7. Navelim
8. Surla
9. Bonus
10. Pissurlem
11. Honda
12. Valvai
13. Velguem
14. Saleli
15. Morlem
Life of the mine mentioned in EIA as 20 years and life of the lease is 50 years. This means all the above mentioned 15 villages will be sucked of water directly daily for decades to come. Is this sacrifice worth doing for the sake of profit of single mining company?

Vedanta has put in its application to Forest department for conversion of forest land to mining purpose. It has also applied to Water Resources Department to pump water out from existing mining pit that was originally operated by Dempos till sold off to Sesa Goa, a subsidiary company of Vedanta.

Vedanta has carried on need based survey for SC/ST population in buffer zone of 10 kms but usurped SC land within mining leased hence its a stolen land and litigations are in the court of law even though EIA report denies this fact.

Cudnem mineral Block VII is one more step towards Goa's ecological destruction through mining blunders.

Goa is too precious and worth fighting for, worth burning mid-night lamp for the sake of life with dignity and freedom. Let's go forth boldly!

Vedanta to put 254 mining trucks per hour on Bicholim Public roads?

Sir,


It has come to our attention that your office is about to provide opinion to the Honorable Goa Bench of Bombay High Court in P.I.L. W.P No. 6 of 2024 recommending transportation of ore on Public Roads, Village roads, District road in Bicholim in order to facilitate Vedanta Limited Bicholim Block - I Mines ore transportation. 


We request you to kindly refrain from allowing such transportation. Transportation of ore to the rate of 120 trips per hour - as recorded in Vedanta limited letter dated 08 April 2024 to your office - would mean invasion of public roads with mighty reckless manner threatening road safety with impunity thereby violating 2022 Supreme Court directions on road safety. 


Environmental Clearance (EC) dated 23 January 2024 records at page 28 of 39 response from Vedanta Limited that total ore that will be transported per day is 12658 tonnes in 1205 trips per day and 127 trips per hour with total vehicles that will be put on road to and fro totaling 254 vehicles per hour. This is sure remedy for creation of a catastrophe for 237 days per year that you need to prevent. 


Moreover you are well advised to organise public consultations with affected people residing close to the vicinity of the roads before providing any permissions to use existing public roads, Village roads, city roads as well as district roads for transportation of ore at such such high rate as 120 trips per hour.


Vedanta Limited has claimed in response recorded in Environmental Clearance page 18 that they have 4.54 km of dedicated road and 0.94 km MDR-20 Public Road.


Directorate of Mines and Geology is not privileged to initiate violation of EC condition to make a mockery of EC. It's legitimacy is very vital by maitaining It's integrity.


Any irresponsible decision on your part would lead to the unpredictably dangerous consequences to the Public Health in Goa and your office will be held responsible and accountable in a fitting manner.


Therefore we assert once again: Please organise public consultations on the issue of granting road permits to transport ore from the Mines to Sarmanas Jetty with affected people of Bicholim Taluka prior to granting of any road permits to Ms Vedanta Limited.

Call to release all those detained due to mining protests in Mayem

Call to release all those detained due to mining protests in Mayem, Bicholim, Goa


According to the confirmed information six people are illegally detained at the Bicholim Police station without any charges in them. They were arrested today 13 January morning at 10.30 am while protesting illegal transportation ore from their village of Mayem from Chowgule mine at Paira, Mayem.


Those amongst six includes Babuso Karbotkat, Santosh Sawant, Santosh Malvankar, Ajit Sawant, Apa Salgaonkar, Naguesh Naik.


Iron ore is being transported by contactor Dinesh Gauns through the village road in Mayem and is objected by villagers. 


It is also alleged by the villagers that Goa Chief Minister is directly involved in abuse of police force in his capacity as Home Minister for some petty selfish gains and detriment of the Public Interest. It is not know as to how much of 35,000 crores of mining scam has reached Goa Chief Minister as evidently he is silent on recovery of this amount.

Minutes of Vedanta Limited Public Hearing as Public Butchery

With Mining company ex-Environmental cum Public Relations officer as the Chairman of the Goa State Pollution Control Board in the form of Mahesh Patil (https://goaspcb.gov.in/constitution-of-board/) the autonomous institution has been drastically reduced in their capacity to deal with conduct of public hearing in suitable and efficient manner. At Sarvan on 11 August 2023 Public Hearing norms were flung to the winds. At the end of the Public Hearing minutes were to be prepared and shared. It was not done till 1.30 am on 12 August 2023. Notes taking capacity was in total mess. People had no idea as to whose names are omitted and whose names are included. Entire staff of GSPCB looked in total disarray. It looked that space given to the staff of London based Anil Agarwal's company Vedanta Limited staff on the stage were controlling the strings behind the scene behind the installed black curtain on the stage.



Minutes of the Public Hearing was declared by the North Goa Collector will be put out on the website in two days time. Finally today it is online after five days at https://goaspcb.gov.in/wp-content/uploads/2023/08/MINUTES.pdf. One look revealed that the entire page 12 is missing. Names of speakers and their contribution from serial no 33 to 35 has vanished. There has been careful deletion of contents and names of the speakers too. Nilesh Karbatkar from Mayem who is the Union leader of the Sesa Goa mining corporation has been marked absent "not present" at serial number 153 even though he not only was present and also spoke critically about Vedanta. Noted voice critical about mining in Goa Ramesh Gauns saw that his speech recorded at the minutes is nothing short of butchery at serial no.124.


There is no hope for improvement. Crisis that has set in has taken chronic proportions. As long as Vedanta has its ex-employees as the Chairman of GSPCB nothing really expected to change. As this is the first Public Hearing of the Auctioned iron ore mines things have become clearer than ever: mining industry has taken firm grip over the GSPCB and butchery in noting of minutes and writings of minutes will be sharpened as the days goes on, maturity of butchers increase.


A new league of money games has just become visible!

Objections on Block - I Bicholim Mineral Block

Subject: Objections to the commissioning of Block-I Bicholim Mineral Block by Vedanta Limited


Madam,


We strongly object to the commissioning of Block-I Bicholim Mineral Block by Project Proponent (PP)Vedanta Limited on following grounds:


1. PP applied to MoEF & CC for Terms of Reference to Prepare EIA report on 16 March 2023. In their application PP disclosed that their period of baseline data collection lasted from 01 October 2020 to 31 December 2020 covering one post monsoon season. Executive summery (Page 04) of Block-I Bicholim Mineral Block states that MoEF&CC accorded Terms of Reference on 16 June 2023 and Baseline Data was collected during the period from March to May 2023. So there is fraud committed by PP by providing two different dates of periods of baseline data collection. This is indeed a fraud because EIA report does not mention anything about baseline data collection period of 01 October 2020 to 31 December 2020. Moreover that was time of Covid-19 lockdown in Goa. In view of these fraudulent manipulations and inconsistencies observed baseline data collection period is a suspect. PP therefore be directed to prepare fresh EIA without any inconsistencies on period of data collection and conduct fresh Public Hearing as per ToR no.70.


2. Neither the PP nor the Goa Government has consulted local decision making bodies namely the Panchayats before going for auctioning of the mine. This way of functioning is completely anti-democratic. We therefore strongly object to the way auctioning process itself has been carried on. 


3. We take strong objections to the Reference to this mine in EIA as "Green Field Project". This amangation of 05 mines is operating as per available records from the year 1941 and has completes 82 years of its functioning on 20 August 2023. Moreover as per online sources PP is associated with these Mines from 2009 and as per records with Department of Mines and Geology PP proponents logo appears on large number of correspondence concerning these amalgamated Mines like the letter of Agent M.K. Reddy to the Central Empowered Committee (CEC) dated 14 November 2012 denying illegal mining and encroachment by M/s Dempo & Souza (Sesa Resource). Moreover page 16 of EIA admits that there are totally 5 pits within the proposed mining lease and Table 2.5 even presents details of Active pits. Further Mines Minister and Chief Minister of Goa Dr. Pramod Sawant on 09 August 2023 has stated on the floor of the Goa State Assembly that these amalgamated Mines in under EIA consideration are granted for the same company who used to operate before 2012 Supreme Court ban. 4. PP therefore inherit all the liabilities of all the five Dempo amalgamated Mines: 11/1941, 12/1941, 13/1941, 14/1941 and 15/1941. Dempo mining corporation private limited was renamed as Sesa Mining Corporation Limited on 18 November 2010. There already exists sufficient evidence of public nuisance and environmental security threats already created by these amalgamated Mines over the past 82 years of which PP is associated directly and indirectly from 2009 for 14 years. Research Article published in Research Journal of Environmental and Earth Sciences 11(1): 1-13, 2019 titled "Impact of Past Iron Ore Mining on the Sediment Ore of Rivers of Goa: West-coast of India by N.T.Rane and V.M. Matta of the Department of Marine Science,  Goa University has made critical observations regarding Bicholim River that according to the Executive Summery flows at the distance of 0.23 kms from the Lease boundary carry large amount of polluted water into its waters. Abstract of this scientific study notes "the study revealed that the Bicholim river is strongly polluted with Fe & Pb...High contamination of Fe and MN and considerable contamination for Pb and Cr in Bicholim River sediment core can be attributed to enormous mining activities and discharge of wastes in this region." In the light of this study commissioning of Block-I Bicholim Mineral Block will further aggravate ecological health of Bicholim River that connects Mandovi river. Thus study has been ignored by PP thereby for their ulterior motives to contaminate and pollute Bicholim River.


5. North Goa Disaster Management Plan 2023 on page 184 foresees landslides due to mining in three Villages due to this amalgamated mine. In Mulgao survey numbers 116 and 117, 80 houses and 55 hectares of land is forecasted to be impacted. In Maem 30 houses and 25 hectares of crops are predicted to be negatively affected. In Sirigao survey numbers 81 & 85 are classified to be likely damaged due to mining triggered landslides. Goa Government has already accepted landslides threats due to mining. Actual threats are much more serious and dangerous. On this ground too Block -I Bicholim Mineral Block must not be permitted to be commissioned.


6. Modification to Approved mining Plan dated 26 October 2017 presented on the floor of the Goa Legislative Assembly by Chief Minister Dr. Pramod Sawant in response to LAQ from Yuri Alemao states name of this mining lease as M.L. No. 08/AMLG(MG-5)SMCL/17. This information is concealed in EIA. Further page no. 07 states that out of 478.5206 Ha lease area of this mining lease 407.7446 Ha is acquired. That means 70.7446 Ha of land is not aquired. Which are the survey numbers and villages where this yet to be aquired land is located? This information is concealed in presented EIA report by PP. Further Page no. 09 of the modification to Approved mining Plan states that Bicholim Amalgamated mine was granted lease on 20 August 1941 and expires on 21 November 2027. All these details are concealed from EIA report. Information furnished in EIA Study is defective and misleading and PP be directed to prepare fresh EIA and hold Public Hearing afresh.


7. This amalgamated Mine PP is involved illegal mining activities and owes more than 100 crores of Rupees to the Goa State as revealed from the LAQ discussion on the floor of Goa Legislative Assembly on 09 August 2023. Print copy of the colored Google map attached as Annexure I in the 11/1941 mining lease file at the Goa Department of Mines and Geology, reveals investigations by Shah Commission revealing expansion of mining activities beyond lease boundary taken by hand held GPS and Sesa Goa Limited Lease boundary taken by DGPS. Its illegalities are confirmed. EIA reports has not attached any document certifying that PP are not involved in illegal mining at this amalgamated mining site. This I in violation of ToR no. 07 and among major grounds for rejecting PP application to commission mining at the proposed site.


8. EIA report does take into account destruction of paddy fields, drying of ground water of 60 wells in Sirigao village due to mining activities of the PP together with other two existing Mines of Chowgules and Bandekars. Cummilitive impact of the village due to operation of these Mines is already a mega disaster encompassing human habitation and religious structures. The to Assanora river due to seepage of river water into mining pit is grave and have not been dealt with in adequate manner. Moreover objections of the villagers against commissioning of auctioned Mines in the village filed before the Goa Government authorities are ignored by the PP. NEERI report has already proved thar siltation of Sirgao paddy fields is due to mining leases operating in the village including the mine that PP desires to commision.


9. PP has pathetic track record in treatment of people and ecology. They are involved in Nadidihi Iron Ore mine of ESL Steel Limited in Jharkhand, India. Currently people residing nearby are compeled to use polluted and untreated beneficiated water from its mines for drinking purpose. 


10. Such glaring violations are carried on by PP by efficient Public Relations. In fact one ex-officer of PP is currently Chairman of the Goa State Pollution Control Board named Mahesh Patil.


11. Conduct of the PP can be understood from the observations made in its Judgement in T.N.Godavarman Thirumulpad....(Petitioner) versus Union of India....(Respondents)and in the matter of Vedanta Alumina Ltd ...(Applicant) of 23 November 2007. Four observations of construction Supreme Court we quote here. (1) NORWAY has dropped British mining and metals group Vedanta Resources from its $ 350 billion oil fund at the recommendation of the Fund's Ethics Council, which blamed it for environmental damage and human rights violations, the Finance Ministry said. (2) Vedanta Resources is accused of having caused environmental damage and contributed to human and labour rights violations. (3) We cannot take the risk of handing over an important asset into the hands of the company unless we are satisfied about its credibility. (4) In the corvumstances keeping in mind the totality of the above factors, we are not inclined to clear the Project. Company with such a dubious record must not be allowed to commission the amalgamated lease.


12. Major water bodies such as lakes five lakes in Mulgao and seven lakes in Lamgao village are not included in the baseline data of the presented EIA/EMP report. Lakes in Mulgao occupy 21,050 square meters of land covering survey nos. 71/0, 69/1, 61/2, 257/1 and 117/1. In Lamgao seven lakes cover area of 6,925 square meters of land covering survey nos. 5/18, 8/1, 14/1, 14/3, 22/9 and 25/1. Additionally several fresh water springs in Maem village is excluded from baseline data in EIA. Total lake area amounts to nearly 03 ha. PP be directed to conduct fresh EIA with correct baseline data and go go for fresh Public Hearing.


13. Maem lake springs numbering two dried up. Before the mining pit was excavated for the ore for more than 50 years resulted in drying up of two springs that emptying water into Maem lake. This is because ground water regime got disrupted as the depth of the mining pit increased steadily.


14. In the close proximity of this mining project there are 25 wells in Bicholim with water. PP carried on the study on ground water from the various villages beyond Bicholim Town. Wells are the indicators of the ground water existence in the region. There are at least 25 wells in the close proximity of mining area. Consultants should have studied water levels in the wells in the lean period of summer that is May but this is not done as per EIA. Sirigao and Pissurlem are classic example where wells have dried up due to the mining pits which have gone below 50 to 60 meter depth and resulted in drying up of wells. This fact has been denied by all the mining companies in Sirigao that their mining pit caused it. Histoy of wells going dry will repeat in all the wells situated in close proximity to the mine and trigger off blame game between the locals and the PP. PP should have consulted Water Resources Department, Government of Goa on the question of ground water. In Maem at the foot hill of 2 Top Hillock there are 2 small lakes ( tanks) which go dry in the month of March, April and May. Springs also dry up due to the mining pit on the other side of 2 Top.


15. EIA Executive summery page 07 states “Mine does not have any forest land within the lease. The area is located on the foot hills of western ghats belt.” It is not true that the area is located on the foot hills of the western ghats belt. The distance between this mining project and the foot hills of western ghats is around 22 kms. In the foot hills of the Western Ghats is Taluka of Sattari. Whereas the Bicholim Taluka where this mine is located is Plateau region. Therefore the baseline data appears to be the cut and paste job. Hence this EIA study cannot be accepted for this Public Hearing to avail EC.


16. EIA Executive summery comment on page 07 “Mine does not have any forest land” is misleading. Name of at least one of the amalgamated mine 12 of 1941 indicates that there was forest here when the lease was granted 82 years ago. The name of this mine is Vagachiper that mean tiger favoured spot.. Tiger need forest as habitation and this mine was forest in 1941 until mining destroyed the same. Similarly mining lease 14 of 1941 that is part of amalgamated mine is named Toticho mor which means Peacock with a beak. This indicate that then existed forest where there were plenty of Peacocks. There is still Government Forest that is encroached by mining company in Mayem village. Boundary limit of 2 top in Maem is covered under forest land currently under company’s illegal possession.


17. Mining as serial disaster:This amalgamated mine has a history of triggering disasters. BIcholim was flooded on 13 June 1981 causing huge damage to the property. Government appointed expert committee to investigate the occurrence of flood in BIcholim. Page 236 of Fish, Curry and Rice: A source book on Goa, its ecology and lifestyle (2002) has reported that government appointed committee concluded that 1981 Bicholim floods were because of nearby mine. Nearby mine then belonged to Dempo Mining Corporation. In Accident of 1991 at Valshi in Bordem wherein 04 pople were killed, 06 injured and 144 farmers lost their paddy crop. Mining accident on 20 November 2011 in Mulgao caused breach of bund leading to siltation of paddy fields, siltation of arecanut plantations and silt entered nearby village temple. There was huge run off in 2009 at Paj wadda, Bicholim during rainy season. Water gushed down into locality carried mining silt, stones, mud on the entire road from Zantye Cashew factory to the building where LIC office is located. Cause stretched upto Petrol Pump and Shops. Nearly all the houses in Paj wadda had generous deposit of mining silt. 


18. Page 07 of Executive Summery notes “The general elevation of ML area varies from 169.14 m to -37.24 m above MSL.”  With 169.14 m elevated location disasters cannot be managed. In spite of all the precautions disasters are bound to occur. We recommend that since disasters cannot be avoided this mining project must be closed.


19. EIA does not mention anything about beneficiation plan. It gives an impression that ore will be exported without washing. However the approved modified plan tabled in the Goa State Legislative Assembly mentions wet beneficiation plan for at Mine portion at Top Pit 1. 


20. Page 16 of EIA notes that the “slope of Overburden and Mineral benches shall be maintained at 70 degree and overall slope of <26 degrees respectively.” What is the gradient of highest point of the core zone with respect o Town of BIcholim, River Bicholim, villages of Lamgao, Mulgao, Sirigao, Bordem and Maem? With 3500 mm of rainfall mentioned in the EIA report with 70 degrees gradient of overburden disaster in monsoon season is inevitable with elevation of 169.14 meters. Gradient of mining site without overburden is not given in EIA study.


21. Page 17 of EIA has Table 2.7 Raw Ore Material (ROM) quantity if given as 3000000 tonnes. According to Vedanta letter dated to the Director General (Statistics), Nagpur ROM was reported as NIL. Letter is filed as page 277/C in Mining lease file of 11/1941 at Goa Department of Mines and Geology. In 2015 there is no ROM and then suddenly PP has reported huge quantity of ROM as 3000000 tones. How this discrepancy can be accounted?.


22. EIA of 2003 of Dempo mining corporation gave ore to waste ration as 1:2.5 and the production of 2 million tonnes per annum. The present PP is trying to win 3 million tonnes per annum and also encountering ore to waste ratio as 1:8.39. This is absurd. Possible the exaggerated figure of the ore to waste ration is intentionally given to go for robbing of ore. Considering that illegalities committed by Vedanta in parts of the world and in India too the possibility of the PP carrying day light robber of Goa’s ore is highly possible.


23. Page 149 of EIA at point 4.10 has table that provides trips per day as 1205 tones of iron raw. On calculation it was found that for 30 days it is 36150 tones. Therefore figure for 12 months is 433800 tones. PP has given figure as 3000000 tones. But based on calculations of trips per day annual production doesn’t touch half a million tones per annum. The figures given of tones per day and trips per day do not match the quantity given of 3000000 tones.


24. From 2011 to 2013 Vedanta was alleged by Directorate of Mines and Geology of carrying on illegal mining of 2076746 tones worth Rs. 97.48 crore. Vedanta is habitual perpetrator of economic crimes related to mining. Therefore PP cannot be expected to function at any point without committing illegalities.


25. According to Supreme Court of India Vedanta land for University in Odisha was illegal along Puri and Konark marine drive. Supreme Court stated “It is not appreciable why the government offered such an undue favour in favour of one Trust/Company”. Replica of the this situation has happened in Goa. Vedanta owes 100 crore to Goa Government as per the proceedings of the Goa legislative assembly on 09 August 2023.


26. PP has not consulted any bio-diversity registers at any of the 56 Panchayats and 12 Municipalities in core zone and buffer zone of the mine. Therefore flora and fauna baseline data collection method is faulty and strong ground to reject EIA and direct to prepare fresh one with correct method.  


We hereby suggest that EIA having more than 600 pages to read for a common people is very difficult but beyond that to expect common man to study and participate in the Public Hearing is an impossible task. So either the Pollution Control Board or the consultant of the concern EIAs should bear the responsibility to explain how to study and comprehend technical data by going to the Panchayat or Municipalities. Or if the EIA study exceed 300 pages Public Hearing should be conducted after 60 days.

Good Food, Good life! Bad labour practices, Bad reputation! Lets watch Nestle for demo!

Swiss Multinational corporation Nestle engaged in manufacture of milk products has famous underline: Good Food, Good Life. This underline can be seen at several places in Bicholim Taluka where one of the Nestle plant is located at Van-Maulingem village. The other plant is in Ponda Taluka of Goa. 

This post is concerned with controversial labour practices that has led to labour unrest and litigation over the past few years before the office of Labour commissioner, government of Goa. The central issue of contention is that Nestle has suspended some workers, dismissed others and refused to take them back on job. Labour exploitation and Environmental exploitation are the two facets of workings of capitation for profit maximization. 

Labour exploitation by Nestle is alleged by the workers and agitated in various phases so far. Crux of the matter as we understood after speaking to the agitation Union of the contract workers is this. Nestle refuses to owe responsibility to the fate of the workers who are not taken on the job just because they were engaged by the Contractor. Contractor hired the workers and Nestle benefited as Principal employer usurping surplus from workers efforts. 

Now these workers are denied Job and at the litigation at labour commissioner Nestle denies any links with workers and even refuses to delegate its representative. This has been going on for past almost two years, as we learn from the workers and from the available documents that involves minutes of various meetings convened by labour commissioner and  correspondence with Nestle Plant in Van-Maulingem. BMM contacted the President of the Nestle Contract Workers Union Anand Shirodker and we got the following status report:

Payment of Arreas of settlement benefits not paid to 30 workers for five years from 2013-14 to 2017-18. 

Sixteen workers are not taken on job after the break and contractors are insisting on c0ompiance to hire and fire policy of work. 

Three workers terminated from job allegedly for taking active part in Union activity.

Five workers terminated from from their work in Canteen.

International Union of Foods (IUF) was involved initially to support the workers but eventually ditched the workers for the reasons best known to IUF alone.

Press Release in support of Nestle Contract Workers Union



11th February 2016

Bharat Mukti Morcha (BMM) extends support and solidarity to Nestle Contract Workers Union (NCWU) based at Maulingem, Bicholim. For the past few months BMM has been interacting with NCWU ever since they shifted their agitation in Panjim. BMM is concerned about targeting of Union Leadership in fabricated manner in order to suppressed workers Union activities. BMM has identified that two of the dedicated and talented leaders of the NCWU Anand B. Shirodkar and Sandesh Gawas are placed on suspension. Workers had formed NCWU on 27/11/2012. Our investigation has revealed that Nestle has 8 contractors that supply labour to the factory in Maulingem. One of this S.P.Enterprises has suspended Anand B. Shirodkar while another one M/s Harsh Security and Labour supply services has suspended Sandesh Gawas. Though workers has filed complaint before labour commissioner placing various issues for resolution on 24th June 2013 and number of hearings has gone by ever since. However refusal of the Nestle management to co-operate by their presence has left the issue unresolved. Even the requests from the Goa labour commissioners to remain present for the hearings has not been honored by Nestle management citing the reasons that they are not involved in master – servant relationship with the contract workers. However involvement of Nestle is revealed from the fact that both the Union leaders Anand B. Shirodker and Sandesh Gawas were placed on suspension on the same date of 23/8/2013. One does not need rocket science to guess that this has been done to prevent labour awakening and unionization, and spreading of Union activities and not for cited reasons of criminal behavior and absenteeism from work.
This is a very sad reality of Goa’s industrialization. Innovative forms are deployed for the purpose of labour exploitation with legal immunity for prosecution. Contractors in collaboration with Nestle Company through these practices are involved in the process of mutilation and disintegration disguised as development.  BMM considers what is happening to NCWU as symptomatic of industrial scenario of Goa – rampant labour exploitation through contract labour with exploitation as a package. If Goa Government labour Ministry cannot get Nestle to discussion table then it must change its name as Ministry of Slavery.

How contract workers at Nestle, Bicholim formed their union

Today lets examine the situation of food supply to Nestle contract workers in Maulingem North, Bicholim before 2011. Permanent workers used to be given food. Packers and Tipping contract workers used to be given food. No other contract workers used to be given food on work. House Keeping, Loading-Unloading workers used to go home in the afternoon to get meals on both shifts afternoon as well as Night. Lunch break was just an hour. Traveling used to consume most of the time and energy. Those workers who used to report late after meals used to be scolded. Cooking at home to take meal for work early morning would take efforts and time and often worker would report late at work.

In this context at the General body meeting of the worker Gomantak Mazdoor Sangh decided on May 01, 2011 that Nestle management should provide free meals inside the factory premises. From July 2011 this decision was implemented and Nestle management started giving free meals to the all the contract workers. Factory then had 350 Union members plus 300 more workers who were not the members of the Union but benefited from Union action. Nestle Plant here has about 900 permanent workers. This practice of free meals to all the workers continues till date.

Then Uniform for contract workers was another issue that got on the agenda. Workers used be get uniforms after standing in Que. There was uniform shortages. Company used to give only aprons to wear over the clothes that workers used to wear. Workers agitated and got the Uniform shortages to eliminate and get more Uniforms to be made available. This problem is still not sorted out. It still exists till date. This issue stands unresolved.

Shoes for worker were provided once in six months per pair. Instead of giving good quality shoes poor quality shoes are given to the workers. And those worker who handles water or works in water are not provided any shoes, not even water proof shoes. After agitation also this situation has not changed.

Contract workers were not given double overtime payment for double overtime work. The first timing is from morning 8.00 am to evening 4.00 pm. The Second shift starts at 4.00 pm to 12.00 mid night. The third shift is from 12.00 mid night to 8.00 am. At the end of the shift if the replacement worker has not reported to work then same worker will have to continue into next shift. But company would not pay double overtime but would pay only single overtime. This was a case of exploitation perceived by workers and raised verbally in 2011. This issue got resolved after agitation in June 2011. After this contract workers started getting double overtime. This issue is not completely resolved as company pays only three double overtimes per month even though workers carry on dosing double over time mover than three times every month. This is gross case of exploitation that still continues at Nestle in Maulingem North. We wonder why this is still the case after 54 years Indian Army march into Goa to liberate us. Why contract workers at Nestle continues to languish and suffer this way?

Night allowances are meant for only night shift from 12.00 mid night to 8.00 am. No allowances were given for night shifts. After agitation the night allowances of Rs. 30/- were granted fro a short while. This was stopped after 2013.

Attendance bonus Rs. 250/- would be given to workers after 24 days in month. This was started after the 2011 agitation and stopped in 2013.

Contract workers at house keeping were supplied with improper materials like gloves, wipers, mops with shortages. This issue was taken up before the management and this was issue was resolved to some extend.

In November 2012 Contract workers resigned from Gomantak Mazdoor Sangh. The main reason was that thier Union leader was not ready to address the problems of the Contract workers. Problems like workers harassment, hire and fire policy by which Union committee member Sandesh Gawas and other were fired from the work by the company. Gomantak Mazdoor Sangh, General Secretary Puti Gaonkar refused to support contract worker. This led to tension among workers and finally decided form their own union.  In this manner Nestle Contract Workers Union Ca,me into existence on 27th Novmeber 2012. general body meeting was called to resolve to resign from Gomantak Mazdoor Sangh and register Nestle Contract Worker Union. Adv. Ajitsigh Rane was approached as legal Adviser. Nestle Company tried to dissuade the workers from this decision for unknown reasons.

Maggi ban lifted yet its parent Nestle continues to torment its workers

Anand B. Shirodkar, is a dashing Union leader of Nestle company in Maulingem North in Bicholim taluka. He has been thrown out from job for past two and half years. His fault is to organise workers for justice. Recently he is involved in creating public out reach in various parts of Goa to explain how this multinational company has been arm twisting the workers for the aim of oppression. He has contacted Bharat Mukti Morcha for support along with his fellow workers. 

Bharat Mukti Morcha has examined the case of the workers and calls upon members of public to do the same. After examination we have found the cause of discontent is solely to suppress dynamic and independent leadership of Shirodkar. He is instrumental in forming Nestle contract workers Union  on 13 February 2013. This is most probably the first Union of Contract Workers in the state of Goa and Shirodkar and all his supporting workers deserve great appreciation. Jai Mulnivasi!

BMM condemns knife attack on Sanjay Mayekar of Mayem

Bharat Mukti Morcha strongly condemns the knife attack on Sanjay Mayekar on Nomember 26, 2015 with grievous injuries in Mayem, Bicholim. Sanjay is a brother of Kashinath Mayekar of Mayem Nagrik Samiti dealing with evacuee property issue. At the time of attack Sanjay was a place where survey work was going on to grant land titles to the Mayem villagers. For so long Mayem has witnessed obstacles to legal land access to the villagers while mining companies had obstacle free access to evacuee property in Mayem especially Chowgules that had dried up 300 village water ground wells causing scarcity of water for agriculture. 

Kashinath Mayekar and his brother Sanjay has been involved in questioning this state of affairs for past 3 decades. Kashinath Mayekar along with later Fr. Bismarque Dias shared stage with Hon. Waman Meshram at Bharat Mukti Morcha public meeting on October 29, 2011 at Azad Maidan Panjim. Check this links for picture.
